 Do not sign the document until you are in the presence of the notary.

 Completely fill in all blank spaces in the document before the notary arrives, but do not sign! Incomplete documents cannot be notarized.

 If you have any questions about how to complete the document, contact the person who drafted or requested the document. A Notary Public is unable to provide legal advice or assistance in the drafting and/or completion of documents.

  Every signer must physically appear, be coherent, and present acceptable ID at the time of notarization.

    Know which Notary Certificate you need. The Notary cannot give advice on which one to use.

9 Required Elements

A Florida notary certificate MUST contain ALL 9 elements to be valid. If your certificate is missing any of the elements the notary MUST either write the missing element on the original document, stamp the missing element on the original document or attach a looseleaf certificate that contains ALL 9 elements.

Acceptable Forms of Identification

 The document MUST be current OR have been issued within the past 5 years and bears a serial or other identifying number.  

  

1.  A Florida identification card or driver license issued by the public agency authorized to issue driver licenses.

 

2.  A passport issued by the Department of State of the United States.

 

3.  A passport issued by a foreign government if the document is stamped by the United States Bureau of Citizenship and Immigration Services.

 

4.  A driver license or an identification card issued by a public agency authorized to issue driver licenses in a state other than Florida or in a territory of the United States, or Canada or Mexico.

 

5.  An identification card issued by any branch of the armed forces of the United States.

 

6.  A veteran health identification card issued by the United States Department of Veterans Affairs.

 

7.  An inmate identification card issued on or after January 1, 1991, by the Florida Department of Corrections for an inmate who is in the custody of the department.

 

8.  An inmate identification card issued by the United States Department of Justice, Bureau of Prisons, for an inmate who is in the custody of the department.

 

9.  A sworn, written statement from a sworn law enforcement officer that the forms of identification for an inmate in an institution of confinement were confiscated upon confinement and that the person named in the document is the person whose signature is to be notarized.

 

10.  An identification card issued by the United States Bureau of Citizenship and Immigration Services. 

No Identification? No Problem

  If none of the above-mentioned identification is available, or the name on your ID is different or shorter than what is on the document, then you can use: 


Two Credible Witnesses - That can swear to the signer’s identity. They must have proper ID, be age 18 or older, know the signer by the name on the document, not be named in the document, nor have a financial interest in the transaction described in the document.

 

Signing by “X” Mark - If unable to write signature and has valid ID, then two “disinterested” witnesses need to be present and be witnesses on the document. One witness should write the person’s name next to the person’s mark and the witness should sign his or her name as a witness. The witnesses are only verifying that they witnessed the individual make his or her mark on the document.

What is a Document Witness?


 Someone that witnesses someone signing the document.  


Who Can Act as a Document Witness?


  1. A notary may act as a document witness in the State of Florida, but if the notary is also preforming the notarization they should be sure to clearly document in their journal the name of the person who's signature is being notarized in the document since it is illegal for a notary to notarize their own signature. If the notary is unsure they should decline to act as a document witness. A notary may NEVER act as a credible witness
  2. A person that does not have a financial interest in nor are a party to the underlying transaction

  What is a Credible Witness?   

A credible identifying witness is an individual who knows and can verify the identity of a signer.   


One Credible Witness 

 The sworn written statement of one credible witness personally known to the notary public.  


 Two Credible Witnesses 

 

  1. That the person whose signature is to be notarized is the person named in the document
  2. That the person whose signature is to be notarized is personally known to the witnesses
  3. That it is the reasonable belief of the witnesses that the circumstances of the person whose signature is to be notarized are such that it would be very difficult or impossible for that person to obtain another acceptable form of identification
  4. That it is the reasonable belief of the witnesses that the person whose signature is to be notarized does not possess any of the identification documents specified in the acceptable forms of identification section AND
  5. That the witnesses do not have a financial interest in nor are parties to the underlying transaction
